The money laundering case against Turkey's state-run Halkbank heads to a hearing this morning, the first since Bolton's book and US Attorney Geoffrey Berman's firing heightened concerns of Trump admin interference.

Bolton's book: "Trump then told Erdoğan he would take care of things, explaining that the Southern District prosecutors were not his people, but were Obama people, a problem that would be fixed when they were replaced by his people."

Before today's hearing, Presiding U.S. District Judge Richard Berman told the parties to be ready to propose a trial date.
(No relation between the judge and the ex-U.S. Attorney.)

Halkbank's counsel agrees to waive physical presence in SDNY for today's remote hearing, due to the pandemic.
Judge Berman notes that Halkbank was arraigned at the last conference in March.

Attorney Robert Cary for Halkbank: We have had an opportunity to at least speak by telephone with the government.
He reported "disagreements" with the future direction of the case.
An ongoing problem is traveling to Turkey to visit client, given the pandemic.
Halkbank's Cary: We have not had the chance to meet in-person, but we have had video conferences.
He says the bank will be filing a motion to recuse the judge, proposing a date of July 21.
"In terms of a trial date, we are in the most unusual time in my career," he adds.
Halkbank's attorney Cary says he anticipates there will be a number of classification issues in terms of evidence-gathering.
"This appears to be a case where the vast majority of witnesses are overseas," he says.
He proposes a **March 2022** trial date.
AUSA Michael Lockard is now up to respond to Halkbank's attorney's proposed trial date.
"We think that a trial could be scheduled and should be scheduled much sooner than that."
The prosecution proposes a trial February 2021
"This is not a case where we're starting from scratch," Lockard says, noting that Halkbank's manager Hakan Atilla was tried and convicted years ago.
Halkbank was charged in October 2019.
Prosecutor Lockard notes: "There has been a lot of opportunity for Halkbank to investigate and prepare already to date."
"The most significant effect of Covid is really whether people are available to participate in the trial," he adds, arguing against "unnecessary delays."
Halkbank's Cary says these are difficult times, and he struggled to get on the call. (He was late.)
Halkbank's Cary draws a distinction with the case of the bank's manager Hakan Atilla:
"With respect to trial, it is an entirely different burden to counsel to represent one individual... than to represent an entire bank."
He emphasizes he anticipates classification issues.
Judge Berman proposes a brisk schedule to the recusal motion, starting on July 14.
As for the trial date, Berman says he wants to make an "informed decision" and presses Halkbank's counsel about what will be needed to prepare for trial.
"I'll come up with a schedule," he says.
Judge Berman: "If there's a show stopper date in there that somebody can't manage, we'll talk about that."
Berman adjourns, with the trial date question unresolved.
Mostly scheduling discussed.
Upshot: Halkbank wants a long delay until trial. Prosecution wants February 2021. The bank wants March 2022.
